Privacy Notice for Candidates (Recruitment) regarding the processing of personal data pursuant to Article 13 of Regulation (EU) 2016\/679<\/h2>\n

Dear Candidate,<\/p>\n

A. Brivio Compensati S.p.a.<\/b>, acting as the Data Controller, with registered office at Via Novara 258, 27038 Robbio (PV)<\/b>, Tax Code: 02109430153<\/b> and VAT No.: 02109430153<\/b>, tel. 0384 689211<\/b>, email:hr@brivio.it<\/b><\/a>, hereby informs you that the personal data you have provided to us will be processed in accordance with European (EU Regulation 2016\/679, hereinafter the \u201cRegulation\u201d) and national data protection legislation. The processing will be carried out in accordance with the principles of fairness, lawfulness and transparency, safeguarding your privacy and your rights.<\/p>\n

– Purposes of personal data processing and legal bases for processing:<\/strong><\/b><\/p>\n

The personal data provided by the Candidate (for example, by sending a CV via email, submitting an unsolicited application, completing forms on the company website or attending interviews) will be processed exclusively for the following purposes:<\/p>\n

    \n
  1. managing the application and carrying out activities related to the recruitment process;<\/li>\n
  2. assessing the suitability of the Candidate\u2019s professional profile for open positions or future organisational and business needs;<\/li>\n
  3. organising, where applicable, introductory interviews, providing information or requesting further details regarding the application;<\/li>\n
  4. managing the preliminary steps prior to the possible establishment of an employment relationship;<\/li>\n
  5. safeguarding the rights of the Data Controller and managing any disputes.<\/li>\n<\/ol>\n

     <\/p>\n

    The processing of personal data is based on the following legal grounds, in accordance with Article 6(1) of Regulation (EU) 2016\/679:<\/p>\n

      \n
    • Article 6(1)(b) of the GDPR, as the processing is necessary for the implementation of pre-contractual measures taken at the data subject\u2019s request;<\/li>\n
    • Article 6(1)(f) of the GDPR, for the purposes of pursuing the Data Controller\u2019s legitimate interest in the proper management of staff selection procedures and the protection of its rights.<\/li>\n<\/ul>\n

       <\/p>\n

      Should data falling within special categories within the meaning of Article 9 of Regulation (EU) 2016\/679 (for example, data relating to membership of protected groups or information capable of revealing health status) be provided in the curriculum vitae or during the recruitment process, such data will be processed exclusively to the extent strictly necessary to fulfil the obligations or exercise the rights of the Data Controller or the data subject in relation to labour law and social security, in accordance with Article 9(2)(b) of the GDPR and applicable national legislation.<\/p>\n

      – Types of data processed and methods of processing<\/b><\/p>\n

      As part of the recruitment process, the Candidate\u2019s general personal data may be processed, such as identification and personal details, contact details, information relating to educational background, professional experience, qualifications, skills, references, as well as any further information contained in the curriculum vitae, in applications submitted via the company\u2019s website, by email or via platforms dedicated to human resources management, or provided during interviews.<\/p>\n

      Data falling within special categories within the meaning of Article 9 of Regulation (EU) 2016\/679 may also be processed, should the Candidate voluntarily include such data in their curriculum vitae or disclose it during the selection process, such as data relating to membership of protected groups or information capable of revealing their state of health. Such data will be processed exclusively to the extent strictly necessary and in compliance with current legislation. The Candidate is advised not to include in their CV or in any communications sent any personal data that is not relevant to the purpose of the application or that goes beyond the requirements of the selection process. The processing of personal data is carried out using IT, telecommunications and paper-based tools, in accordance with processing logic strictly related to the purposes indicated above and in compliance with the principles of lawfulness, fairness, transparency and data minimisation. The data may be processed by internal staff who have been specifically authorised and trained by the Data Controller and who belong to the departments involved in the staff selection process, as well as, where necessary, by department heads or external parties formally appointed to manage IT or HR services. The Data Controller implements appropriate technical and organisational measures designed to ensure the security, integrity, availability and confidentiality of the personal data processed, preventing unauthorised access, disclosure, alteration or unauthorised destruction of the data.<\/p>\n

      – Nature of the provision of data<\/b><\/p>\n

      The provision of personal data is necessary to enable the Data Controller to assess the application and manage the recruitment process. Failure to provide data, or the provision of incomplete or inaccurate data, may make it impossible to consider your application or to proceed with the selection process.<\/p>\n

      – Disclosure and transfer of data<\/b><\/p>\n

      Personal data may be processed by internal staff expressly authorised by the Data Controller and involved in the recruitment process, as well as by department heads authorised to assess applications. The data may also be disclosed to third parties providing support services for the management of IT systems and platforms dedicated to human resources management, who, where applicable, are appointed as Data Processors pursuant to Article 28 of Regulation (EU) 2016\/679. Personal data will not be disclosed to the public. Based on the information currently available, the data is processed and stored within the European Economic Area and no transfer to third countries or international organisations is envisaged.<\/p>\n

      – Retention of processed data<\/strong><\/b><\/p>\n

      Candidates\u2019 personal data will be retained for the time necessary to manage the recruitment process and, in any event, for a period not exceeding 24 months from receipt, including for the purpose of assessing any future career opportunities consistent with the candidate\u2019s profile. Once this period has elapsed, the data will be erased or anonymised, unless their further retention is necessary to comply with legal obligations or to protect the Data Controller\u2019s rights in legal proceedings. Should the candidate be recruited, their personal data will be processed in accordance with the privacy notice applicable to employees or contractors.<\/p>\n

      – Rights of the data subject<\/strong><\/b><\/p>\n

      As a data subject, you may exercise the rights set out in Articles 15\u201322 of Regulation (EU) 2016\/679, including the right of access to data, rectification, erasure, restriction of processing, data portability and objection to processing, in the cases provided for by current legislation.<\/p>\n

      This is without prejudice to your right to lodge a complaint with the Data Protection Authority in accordance with current legislation.<\/p>\n
